法院駁回上訴“摑足”商標被判無效 存在貶損國足傾向_顯示
www.ty42.com 日期:2021-05-17 19:31:00| 評論(已有277282條評論)日前 ,掴足濟南國足豆腐餐飲管理有限公司等與國家知識產權局二審行政判決書公開,法院裁判結果為駁回上訴,驳回被判維持原判 。上诉商标损国
該判決書顯示 ,无效本案中 ,存贬訴爭商標為國足豆腐餐飲公司申請的足倾10280516號“摑足”商標 ,核定使用商品為醃製菌塊、掴足腐乳、法院豆腐 、驳回被判豆腐製品 、上诉商标损国腐竹 。无效2020年3月,存贬國家知識產權局裁定訴爭商標予以無效宣告。足倾
法院認為訴爭商標顯著識別部分為“摑足” ,掴足“摑”字,意為“用手掌打 、打巴掌”等 ,國足豆腐餐飲公司將訴爭商標主要使用在豆腐等商品上,存在貶損 、諷刺“國足”的傾向,易產生消極的 、負麵的不良影響 ,訴爭商標違反了商標法相關規定。法院駁回國足豆腐餐飲公司的訴訟請求 。
值得一提的是 ,天眼查App顯示,濟南國足豆腐餐飲管理有限公司已申請多個“摑足”商標,國際分類含方便食品、廣告銷售等,目前商標狀態多為“商標無效”和“等待實質審查” 。
